Our DMCA Status and Responsibilties
XTINA.red and it's properties are protected under Title II of the Digital Millennium Copyright Act. As such, we will respond to any allegations of copyright violations in accordance with the DMCA. Below you will find our policies and takedown notices as required by the DMCA. The following applies to any and all copyright/trademark and owners of intellectual property interested in utilizing this procedure, as well as service users interested in restoring access to material mistakenly taken down.
When a valid DMCA notification is received, the service provider responds under this process by taking down the offending content. On taking down content under the DMCA, we will take reasonable steps to contact the owner of the removed content so that a counter-notification may be filed. On receiving a valid counter-notification, we generally restore the content in question, unless we receive notice from the notification provider that a legal action has been filed seeking a court order to restrain the alleged infringer from engaging in the infringing activity.
XTINA.red will follow the procedures provided in the DCMA to properly enforce rights of copyright holders. When a Proper DMCA notification is received by the designated DMCA Agent, or an administrator becomes otherwise aware that copyright rights are infringed, we will remove or disable access to infringing materials as soon as possible. XTINA.red will not necessarily send a confirmation regarding the removal/disabling.
Our Process For Filing a DMCA Notification
-- Identify yourself as an owner of copyrighted work or exclusive rights that you believe were infringed, or a person acting on behalf of such owner.
-- Provide information reasonably sufficient to permit XTINA.red to contact you. Email is preferred in order to expedite your request, but please provide the following information: name, address, phone number, and email address.
-- Identify the copyrighted work that you believe is being infringed, or if a large number of works are being infringed, a representative list of the works.
-- Identify the location of materials that allegedly are infringing your copyrighted work, by providing URLs on XTINA.red that contain these materials. Please don't send attached images, pdf or other files. We require only a list with XTINA.red URLs. A properly identified request will get immediate results.
-- State that you have "A good faith belief that use of the aforementioned material is not authorized by the copyright owner, its agents, or the law".
-- State that the information in the notice is accurate, under penalty of perjury. You MUST include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
Please note that under Section 512(f) of the DMCA, any person who knowingly misrepresents that material or activity is infringing may be subject to liability.
